TERMS OF SERVICE

These Terms govern use of this website and any purchases made via the official Nashīnasu website (“we”, “us”, “Nashīnasu”). By accessing the site or placing an order, you agree to these Terms.

Subscriptions and collector access are governed by the Nashīnasu Kazoku Collector Access Terms.

1) About the practice

Nashīnasu is an artist-led practice offering original works, limited editions, and collector releases. The practice reserves the right to decline any enquiry, acquisition, or transaction at its sole discretion.

2) Eligibility

You must be legally capable of entering into a binding contract to use this site and place an order. If you purchase on behalf of an organisation, you confirm you have authority to bind it.

3) Orders and contract formation

Product listings constitute an invitation to purchase. A contract is formed when we accept your order and confirm payment. We may decline or cancel orders where reasonably necessary (for example, suspected fraud, errors in listing, or stock/availability issues). If we cancel an order, payments received will be refunded.

4) Pricing and errors

Prices are shown at the time of purchase. If a pricing or listing error is identified, we may cancel the order and refund any payment, or contact you to reconfirm at the corrected price.

5) Payments

Payment is required at checkout using the payment methods offered on the site. Your payment details are processed by third-party payment providers; we do not store full payment card details.

6) Shipping, insurance, and risk

Shipping is governed by our Shipping Policy. All shipments are fully insured and signature required.

For consumers, risk generally remains with the trader until the consumer (or a nominated person) takes physical possession of the goods.
If you authorise delivery to a safe place or a nominated third party, responsibility may change once delivery occurs to that agreed location.

7) All sales final and returns

All sales are final in the sense that we do not offer discretionary returns, exchanges, or refunds for change of mind, preference, or incorrect selection. This is particularly relevant to collector releases, limited editions, and original works.

This does not affect your statutory rights where goods are faulty, damaged, or not as described.

8) Consumer cancellation rights (UK / distance sales)

If you are a UK consumer purchasing online, you may have a legal right to cancel certain purchases within a cooling-off period under the Consumer Contracts Regulations, subject to exceptions (including some bespoke or clearly personalised goods and commissions).
Where a statutory cancellation right applies, we will comply with it. Where an exception applies (for example, a commission/bespoke work), cancellation rights may not apply.

9) Damage, defects, and claims window

If a work arrives damaged, you must notify us within 48 hours of delivery via the Concierge page and provide clear photo/video evidence and your order number. Retain all packaging materials until the matter is resolved. This helps evidence/insurance handling and does not limit statutory rights.

10) Originals, editions, and variation

Original works are unique. Limited editions are produced to defined edition parameters stated on the product page. Colours may vary slightly due to screen calibration; product photos are representative, not guarantees.

11) Certificate of Authenticity

Where stated, a certificate of authenticity accompanies the work. Certificates remain the property of the practice until the order is paid in full and delivered.

12) Intellectual property and permitted use

Purchasing a work does not transfer copyright. Nashīnasu retains all intellectual property rights, including copyright and moral rights, in the artwork and all website content.

You may display the purchased physical work for personal, non-commercial purposes. You may not reproduce, distribute, license, mint, merchandise, or commercially exploit the artwork or images without prior written permission.

13) Prohibited conduct

You must not misuse the site, attempt unauthorised access, scrape content, interfere with security features, or use the site for unlawful purposes.

14) Limitation of liability

Nothing in these Terms limits liability where unlawful to do so (including for death or personal injury caused by negligence, or fraud). Subject to that, we are not liable for indirect or consequential losses. Consumer statutory rights remain unaffected.

15) Third-party links

The site may link to third-party websites. We are not responsible for third-party content or policies.

16) Changes

We may update these Terms from time to time. The version effective at the time of purchase will apply to that purchase.

17) Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Where you are a consumer, you may have the right to bring claims in your local courts. We do not require mandatory arbitration for consumer disputes (and any alternative dispute resolution is voluntary).

All sales are final. We do not offer discretionary refunds, returns, or exchanges. This does not affect your statutory rights.
